§ 5-4-1. Definitions.

  • The following terms, as used in this chapter, have the following meanings, with all terms defined in this Section 5-4-1 in the singular to have the correlative meaning when used in the plural and vice versa:

    City means the City of Sandersville, Georgia.

    Effective date means the date this ordinance is adopted by the Council of the City of Sandersville, Georgia.

    Equipment means the poles, wires, electrical conductors, conduits, subways, manholes, fixtures, appliances and appurtenances that are located in the rights-of-way.

    Ordinance means this ordinance, together with any appendices, amendments, or modifications attached thereto.

    Person means an individual, a corporation, a partnership, an association, a trust or any other entity or organization, including a governmental or political subdivision or an agency or instrumentality thereof.

    Rights-of-Way or Streets means the streets, alleys and public places of the City within the corporate limits of the City, as the same now exist or may be hereafter extended or altered, and any location thereon, there-over or thereunder, and any portion thereof.

    Services means any telephone service, interconnection service, access service and any other telecommunications services provided by a telephone company in connection with the telecommunications system, except for "cable service," as that term is defined at 47 U.S.C. 522(6).

    Telephone company means any person that is engaged in the provision of telephone exchange service or exchange access over a telecommunications system or the provision of any other telecommunications services over a telecommunications system. Such term does not include a person insofar as such person is engaged in the provision of a commercial mobile service, including wireless telecommunications services, and does not utilize the streets to provide such services.

    Telecommunications system means the system over which services are provided inclusive of all equipment.
