§ 9-2-50. Closing requirements.

  • (a)

    Distilled spirits shall not be sold for consumption on the premises at any of the following times:

    (1)

    At any time on Christmas Day, Thanksgiving Day or Sunday except as set out in Subsection (a)(4) and (b) hereafter.

    (2)

    At any time in violation of a local resolution, ordinance, or regulation or special order of the Board of Commissioners.

    (3)

    At any time or place prohibited by state law or by regulations of the State Revenue Commissioner.

    (4)

    On any Monday through Friday before 9:00 a.m. or after 12:00 midnight; on Saturday before 9:00 a.m. or after 12:00 midnight; on Sunday except as set out herein.

    (b)

    The sale of alcoholic beverages for consumption on the premises is hereby authorized on Sunday from 12:30 p.m. to 11:00 p.m. in any licensed establishment which derives at least fifty (50) percent of its total annual gross sales from prepared meals or food in all of the combined retail outlets of the individual establishment where food is served and in any licensed establishment which derives at least fifty (50) percent of its total annual gross income from the rental of rooms for overnight lodging.

    (c)

    Beer and/or wine shall not be sold for consumption on the premises:

    (1)

    At any time on Christmas Day, Thanksgiving Day or Sunday except as set out in Subsection (a)(4) and (b) above.

    (2)

    At any time in violation of a local resolution, ordinance, or regulation or special order of the Board of Commissioners.

    (3)

    At any time or place prohibited by state law or by regulation of the State Revenue Commissioner.

    (4)

    On any Monday through Friday before 9:00 a.m. or after 12:00 midnight; on Saturday before 9:00 a.m. or after 12:00 midnight; on Sunday except as set out in subsection (a)(4) and (b) above.
